Terms of Service

Please read these Terms carefully. They include a limitation of our liability, a waiver of class actions where the law allows, and rules about what you can publish. We've tried to keep them readable.

1. The agreement

These Terms of Service ("Terms") are a binding agreement between you and the operator of bandz ("bandz", "we", "us") covering your use of bandz.rip, its subdomains and any related services (together, the "Service").

By creating an account, signing in, or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service. If you use the Service on behalf of an organisation, you confirm you have authority to bind it, and "you" includes that organisation.

2. Who can use it

  • You must be at least 13 years old, or the minimum age for using online services without parental consent where you live (16 in some EU countries), whichever is higher.
  • If you are under 18, you confirm a parent or legal guardian has reviewed and agreed to these Terms for you.
  • You can't use the Service if we have previously banned you, or if you are barred from receiving services under applicable law, including sanctions laws.

3. Your account

  • Give us an email address you control and keep it up to date. Anyone who can open your sign in links can use your account, so keep your email secure.
  • You are responsible for everything that happens under your account. Tell us right away at hello@bandz.rip if you think someone else has access.
  • One person per account. Don't create accounts in bulk, by automated means, or to hoard, resell or trade usernames.
  • You can delete your account at any time from Settings.

4. Usernames

Usernames are first come, first served. They are a licence to use a name on the Service, not property you own, and you may not sell, transfer or rent them. We may reclaim or change a username that:

  • impersonates a real person, brand or organisation, or is likely to mislead people about who runs the page;
  • infringes someone's trademark or other rights, following a valid complaint;
  • is offensive, or was registered to squat, sell or block others; or
  • belongs to an account that has been inactive for a long time.

We also reserve certain names for the Service itself. When you change your username, old links stop working.

5. Your content

"Your Content" means anything you add to the Service: your name, bio, avatar, links, images, video and audio URLs, card text and settings. You keep ownership of Your Content.

You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, cache, reproduce, format, display and distribute Your Content, solely to operate, secure, promote and improve the Service. This includes showing it on your public page, in link previews and social cards, and in backups. The licence ends when you delete the content or your account, except for copies in routine backups (which expire on their normal schedule), content others have already shared, and anything we must keep by law.

You promise that:

  • you own Your Content or have every licence, consent and permission needed to use it this way, including from anyone shown in it;
  • Your Content and your use of the Service don't break any law or anyone else's rights, including copyright, trademark, privacy and publicity rights; and
  • media you link to (such as a video background or audio track) is something you are allowed to use and share publicly.

Your page is public. Anyone on the internet, including search engines, can see and copy what you publish. Don't put anything on it you want to keep private.

6. What you can't do

You agree not to use the Service to post, link to, or take part in:

  • anything illegal, or that promotes or facilitates illegal activity;
  • sexual content involving minors, in any form. We remove it and report it to the relevant authorities, such as NCMEC;
  • sexually explicit or pornographic material, or links to it;
  • harassment, bullying, threats, incitement to violence, or content that promotes terrorism or violent extremism;
  • hate speech or content that attacks people based on race, ethnicity, national origin, religion, disability, sex, gender identity, sexual orientation or similar characteristics;
  • content that encourages self harm or suicide;
  • other people's private information (doxxing), or intimate images shared without consent;
  • impersonating any person or organisation, or misrepresenting your affiliation with them;
  • malware, phishing, credential harvesting, scams, fake giveaways, pyramid schemes, or links that disguise where they go;
  • the sale of drugs, weapons, counterfeit goods, stolen accounts or data, or other regulated goods where it is unlawful;
  • unlicensed gambling, or financial or investment schemes that are misleading or unlawful;
  • content that infringes copyright, trademarks or other intellectual property;
  • spam, including using your page mainly to drive traffic through deceptive redirects or link farms.

You also agree not to:

  • probe, scan, attack, or try to break or bypass the security, rate limits or access controls of the Service;
  • scrape, crawl or harvest data from the Service in bulk (normal search engine indexing is fine), or collect information about other users;
  • overload the Service, or artificially inflate views, clicks or other statistics;
  • reverse engineer the Service except where the law expressly allows it despite this restriction;
  • resell, sublicense or offer the Service to others without our written permission; or
  • help anyone else do any of the above.

Found a security issue? Please report it privately to hello@bandz.rip and give us reasonable time to fix it before disclosing it. Good faith research that follows this rule and doesn't harm users or data won't be treated as a breach of these Terms.

7. Moderation, reporting and enforcement

We don't review everything before it goes live and we aren't responsible for content users publish, but we may review content at any time. If you see something that breaks these Terms, report it to hello@bandz.rip with the page URL and what is wrong.

If we believe you have broken these Terms or the law, or that your content puts users, us or third parties at risk, we may remove or hide content, disable links or widgets, reclaim your username, or suspend or close your account. Where it is reasonable and lawful, we will tell you what we did and why, and you can reply to that notice to ask us to reconsider. For serious or repeat violations, or where we are legally required to, we may act without notice.

We may also preserve information and share it with law enforcement where we believe in good faith that the law requires it or that it is needed to prevent harm.

9. Third party services and trademarks

Widgets and integrations show data from services such as Discord, Last.fm, GitHub, Steam, Twitch, Riot Games, Roblox and Open-Meteo. When you connect one, you confirm you are allowed to share that data publicly, and your use of that service is governed by its own terms. We don't control those services and aren't responsible for their data, availability or changes. A widget can stop working at any time if a provider changes or restricts access.

bandz is not affiliated with, endorsed by or sponsored by any of those companies. All product names, logos and brands belong to their respective owners and are used only to identify the services. bandz isn't endorsed by Riot Games and doesn't reflect the views or opinions of Riot Games or anyone officially involved in producing or managing Riot Games properties. Riot Games and all associated properties are trademarks or registered trademarks of Riot Games, Inc.

Links on user pages lead to sites we don't control. Visiting them is at your own risk.

10. Our service and brand

The Service, including its software, design, text, graphics, templates and the bandz name and logo, belongs to us or our licensors and is protected by law. These Terms give you a limited, personal, non-exclusive, non-transferable, revocable right to use the Service as intended. They don't give you any right to our trademarks. If you send us feedback or ideas, we may use them freely without owing you anything.

11. Changes to the service

We are constantly improving bandz, so features, limits (such as up to 60 cards per page) and integrations may change, and we may stop offering some or all of the Service. If we shut down the Service entirely, we will give reasonable notice where we can so you can export your information.

12. Ending this agreement

You can stop using the Service and delete your account at any time. We may suspend or end your access as described in the moderation section. When your account is deleted, your public page goes offline and your username may become available to others. Sections that by their nature should survive, including content licences needed for backups, disclaimers, limitation of liability, indemnity and disputes, survive after this agreement ends.

13. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non infringement. We don't promise the Service will be uninterrupted, secure or error free, that widget data will be accurate or current, or that content will never be lost. Keep your own copies of anything important.

14. Limitation of liability

To the fullest extent permitted by law, bandz and its operators, contributors and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data, goodwill or followers, arising from or related to the Service or these Terms, even if we were told they were possible. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim arose, or 50 US dollars (or the equivalent in your currency).

Nothing in these Terms limits liability that can't be limited by law, such as liability for death or personal injury caused by negligence, for fraud, or for gross negligence or wilful misconduct, and nothing affects your statutory rights as a consumer.

15. Indemnity

To the extent permitted by law, you agree to defend, indemnify and hold harmless bandz and its operators from any claims, damages, losses and costs (including reasonable legal fees) arising from Your Content, your use of the Service, or your breach of these Terms or of anyone else's rights. We will tell you about any such claim and may take control of its defence at our own cost.

16. Governing law and disputes

Before bringing any claim, please contact hello@bandz.rip and give us 30 days to try to resolve it informally. Most problems get fixed this way.

These Terms are governed by the laws of the country where the operator of the service is based, without regard to conflict of law rules. Disputes will be handled by the courts located there, except that you may bring a claim in the small claims court where you live, and either side may seek urgent injunctive relief anywhere. If you are a consumer in the EU, UK or another place whose law gives you the right to sue in your home courts, or the protection of your local law, nothing here takes that away.

To the extent permitted by law, claims must be brought individually, not as a plaintiff or class member in a class or representative action.

17. General

  • Changes to these Terms. We may update these Terms. For material changes, we will notify you by email or on the Service at least 14 days before they take effect, unless the change is required by law or to address abuse. Continuing to use the Service after that means you accept the new Terms. If you don't, delete your account.
  • Entire agreement. These Terms and the Privacy Policy are the whole agreement between us about the Service.
  • Severability. If any part is found unenforceable, it is limited to the minimum extent needed and the rest stays in effect.
  • No waiver. If we don't enforce a right right away, we haven't given it up.
  • Assignment. You can't transfer your rights under these Terms without our consent. We may transfer ours as part of a merger, acquisition or sale of assets, and will tell you if that happens.
  • Force majeure. We aren't responsible for delays or failures caused by events outside our reasonable control, such as outages at hosting or third party providers, attacks, or natural disasters.
  • Language. If these Terms are translated, the English version controls where the law allows.
